Terms of Service

You must be at least 18 years old to use PostDaily. You are responsible for the activity that happens under your account and for keeping your credentials secure. Please notify us promptly of any unauthorised use of your account.

PostDaily offers free and paid plans. Paid plans are billed in advance on a monthly or annual basis and renew automatically until cancelled. Billing and payments are handled by our payment provider, Polar, which acts as merchant of record. Any free trial converts to a paid subscription unless you cancel before the trial ends. Fees are non-refundable except where required by law or where we or our payment provider expressly agree otherwise; you can cancel anytime from your billing settings and keep access through the end of your current billing period. Prices are exclusive of applicable taxes unless stated otherwise.

We may offer promotional codes, discount codes, Creator Partner codes or other promotional pricing from time to time. A promotion may carry conditions — eligibility or new-customer requirements, an expiry date, eligible plans, a minimum purchase, a limit on how many times a code can be used, or a limit on how long the discount lasts.

Unless a promotion says otherwise, a discount does not change the normal renewal price once the discount has ended. A Creator Partner promotion, for example, may give an eligible new customer a discount on their first paid subscription payment only, after which renewals are charged at the standard price.

Promotional codes:

• have no cash value;
• cannot normally be exchanged for cash;
• cannot normally be applied retrospectively to previous payments;
• may not be combined with other promotions unless expressly permitted; and
• may be withdrawn, suspended or changed where reasonably necessary.

We may reject or cancel use of a promotional code where we reasonably believe it has been used fraudulently, manipulated, used contrary to its stated conditions, used for self-referral or artificial transactions, or obtained or distributed through prohibited activity. Existing active subscriptions are not normally eligible for Creator Partner new-customer promotions unless a campaign expressly says so.

We operate the PostDaily Creator Partner Program, which allows approved creators, businesses and other partners to promote PostDaily using approved referral links and promotional codes. Approved Creator Partners may be eligible to earn commission when qualifying new customers subscribe through their valid referral link or promotional code.

Participation is governed by the separate Creator Partner Program Terms, which cover application and approval, referral tracking and attribution, customer discounts, qualifying subscriptions, commission calculation and recurring commission, refunds and chargebacks, holding periods and payouts, advertising disclosures, prohibited promotion, fraud and abuse, suspension and termination, and partner responsibilities. Applying does not guarantee approval, and Creator Partner status begins only once we confirm an application has been approved.

When you visit PostDaily through a Creator Partner referral link, or use a valid Creator Partner promotional code, we may record referral attribution in accordance with our Privacy Policy and Cookie Policy. Attribution does not give the Creator Partner access to your account. Creator Partners are given aggregate referral and commission statistics, and are not shown individual customer names, email addresses, billing details, connected social accounts or other information that identifies you.

Where a valid Creator Partner code provides a customer discount, the discount and its eligibility conditions are shown as part of the relevant promotion or at checkout.

You agree not to use PostDaily to:

• publish unlawful, infringing, deceptive, hateful or harmful content;
• send spam or violate any social network's own terms of service;
• infringe the rights of others;
• attempt to disrupt, reverse-engineer or gain unauthorised access to the Service.

We may suspend or terminate accounts that break these rules.

You authorise PostDaily to access and publish to the social accounts you connect, in accordance with each platform's terms. You are responsible for maintaining the necessary rights and permissions for those accounts and for the content you schedule through them. The social platforms are independent third parties; we are not responsible for their availability or for their decisions — for example, if a platform rejects, delays or removes a post.

YouTube. PostDaily uses YouTube API Services to publish to a connected YouTube channel. By connecting one you agree to be bound by the YouTube Terms of Service in addition to these terms. Your PostDaily subscription is for the Service as a whole — we do not charge for YouTube uploads or for access to any platform's API.

Exporting YouTube data. Where the Service lets you export data (for example, the CSV downloads in Analytics), any YouTube data in that export remains subject to the YouTube API Services Developer Policies. You may store exported YouTube data for no longer than 30 days. On or before the thirtieth day you must either refresh it from the YouTube API or delete it, and you must delete it immediately if you disconnect the channel or revoke our access. You may not use exported YouTube data to create independent or derived metrics, and you may not share, sell or otherwise pass it to a third party.

You retain all ownership of the content you create in PostDaily. You grant us a limited, worldwide, non-exclusive licence to host, store, process, transmit and display that content solely to operate the Service — for example, to publish a post you have scheduled. We claim no ownership of your posts or media. You are responsible for your content and for ensuring you have the rights to use and publish it.

PostDaily's AI assistant generates suggestions to help you write. Output may be inaccurate or unsuitable and is provided "as is" — you are responsible for reviewing, editing and deciding whether to publish it. This includes anything the assistant proposes about your schedule or past results: it never publishes or schedules a post without you confirming that action. You must not use the AI features to generate unlawful or infringing content.

AI use is metered in credits, and each plan includes a monthly allowance. One credit covers a single request to the assistant. When a workspace has spent its allowance the assistant pauses until the allowance resets at the start of the next month, or until the plan is upgraded; the rest of the Service is unaffected.

The Service, including its software, design, branding, logos and name, is owned by Galaxyway AI Ltd and protected by intellectual property laws. These Terms do not grant you any right to use our trademarks without our prior written permission.

The Service integrates with third-party services, such as the social networks you connect and our payment provider. Your use of those services is governed by their own terms, and we are not responsible for them.

We work hard to keep publishing reliable, but we do not guarantee that the Service will be uninterrupted or error-free, or that every third-party network will accept every post. We may add, change or remove features, and carry out maintenance, from time to time.

The Service is provided "as is" and "as available" without warranties of any kind, to the maximum extent permitted by law.

Nothing in these Terms limits any liability that cannot be limited by law — including liability for death or personal injury caused by negligence, or for fraud. Subject to that, and to the maximum extent permitted by law, PostDaily and Galaxyway AI Ltd will not be liable for any indirect, incidental or consequential loss, or for lost profits, revenue or data, arising from your use of the Service. Our total liability to you is limited to the amount you paid us in the twelve months before the claim.

You may stop using PostDaily and delete your account at any time. We may suspend or terminate access if you breach these Terms or use the Service in a way that could cause harm or legal risk. On termination your right to use the Service ends, and we will handle your data as described in our Privacy Policy.

Terminating a normal PostDaily account does not necessarily determine every right or obligation relating to a Creator Partner relationship. Where you take part in the Creator Partner Program, suspension or termination of your participation, referral attribution, commission and any outstanding payouts are governed by the Creator Partner Program Terms.

These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute, except where mandatory consumer law gives you the right to bring proceedings in the courts of your country of residence.

We may update these Terms from time to time. We will update the "last updated" date above and, for material changes, give notice in the app or by email. Continued use of the Service after an update means you accept the revised Terms.

Changes to the Creator Partner Program may also be governed by the separate Creator Partner Program Terms. Where we materially update those terms, we may give notice to participating Creator Partners where appropriate.
